I have below question regarding my CAP subject H1B visa clock reset.
- I left US on 5th Nov 2011 after completing 2 years 10 months in USA on L1b VISA.
- Came back to USA after 1.2 years on fresh H1B CAP Subject, and it got filed within a year of leaving USA. (I left US on 5th Nov 2011 and H1B CAP subject got filed in Apr 2012 with is valid from Oct 1st 2012 but I entered US with new H1B visa on 10th Jan 2013)
I am hearing different perceptions where few attorney's says it should rest the clock whereas few of them says No as it got filed within a year.
And also hearing that, it would depends on how I-129 got filled by the petitioner when new H1 initiated, so I am confused as currently I need to extend my H1, anyone gone through this situation?
