H4 visa stamping for accepted withdrawn amendment from USCIS for new locaiton
Hi,
I'm working on H1 for location X for the client. Now I've the approved LCA for location X and employer filed Amendment in Dec last week and waited for 2 months but no response from USCIS , so Employer decided to withdraw the Amendment keeping in view of filing H1 extension( petition expires in 5 months) and withdrawn the amendment and finally got the acceptance from USCIS to file H1 extension. Still employer working on H1 filing extension process.
Now spouse is scheduled for h4 visa stamping on 3/23, Spouse needs to carry:
1. LCA for location X , Old I-129, existing I-797 ( am not sure will they file I-129 for location X part of amendment )
(or)
Old LCA, Old I-129 or
(or)
LCA for X, I-129 for X if available
2. How this is going to impact H4 stamping and what precautions need to be taken to avoid any issues incase if employer files H1 extension for location X before 3/23??
