Hi all,
My brother is going to India for his H1B stamping. He has been on H1B since 2005 and now has a I140 approved as well where he can get unlimited H1B extensions. His current H1b approval is till 2017. He will be appearing for consulate interview in Chennai. In the website at one place, it says the following for H1 supporting documents:
“federal tax forms 1040 and W-2 for all the years which you have been employed in the United States”
He is working in USA on H1 since 2005. Does that mean that he needs to bring 10 years of W2 and 1040? Or it implies since his expired H1b visa?
Also, is it generally safe to go for visa stamping interview at this stage or he should ideally wait for his EAD approval before going out of USA?(he applied for his green card in 2010 and still waiting)
