I am on my 7th year of H1B visa.My i140 has been approved. My H1B is valid for another 2 years. I don't have a project right now that's why my pay roll was not running for a month. Now I applied for H4 visa through my spouse's employer. My H4 petition has been filed (not yet got the receipt/appoval). My question is
While H4 process is going on (not approved ),
- if I get a project through my current employer, Can I join the project and withdraw the H4 application and continue with H1B with my current employer?
- if I get a project through different employer, Can I transfer my h1b and withdraw my current h4 petition?
I understand if h4 gets approved then I have go through change of status.
Please advise.
