  • H1-B status at Risk- URGENT help Please

    I was working at Company A on H1-B expiration date 30 June, 2006 (Texas Service Center).

    In Sept 2005 Company B offered me a job to work at its client Z as contractor and filed my H1-B transfer petition; which was received at INS Vermont Center on Sept 22, 2005 receipt date Sept 26, 2005. Status of Approval of this petition is still pending per USCIS website as of 03-19-06; and I have a printout from the website. (I was employee of Company B and contractor at Z.). In Sept 05 I submitted an application for leave with out pay to Company A and they approved it.

    On Sept 26, 2005, I started working at Z as a contractor. On Jan 20, 2006, company B informed me on phone that Z did not need my services any more. I have pay stubs from company B till Jan 27, 2005.

    I returned to work to Company A from Jan 28, 2005 as my visa for Company A has expiry date June 30, 2005. I did not notify INS of this return to work to company A.

    On Feb 21 Company B informed me via e-mail (later by notice in mail as well) that they were going to terminate my services with effective date from 03/22/06. (They have not yet notified INS of termination yet, but may notify on March 22 or on any date later). I am working at company A and getting my pay and pay stubs.

    Now I have two job offers from Company C & Company D with. They are willing to file my H1-B petition in the week of March 20 -24.

    Now my questions are:

    1. Is there a risk of my going to be out of status?
    2. If yes what should I do?
    3. What should I do now to get my H1-B approved from company C or D?
    4. Which paystubs should I use (from A) or (from B)
