I applied for H1B last year with a consultant. It got picked up in the lottery but I got RFE. My consultant replied to the RFE. Few day back I came to know that the RFE got rejected. As per the response from USCIS for RFE rejection, "the USICS could not establish the relation that who will be control the employee". Also when I confronted my consultant about this he told me that he was not able to get the Client letter at that time. And he did not put the client letter in the response that he gave for RFE
Now my consultant is telling that he will obtain the Client-Letter and will apply for the RTR / MTR. I have a few questions regarding my case :
1. What is the probability of my H1 getting approved via RTR/MTR.
2. How long does it take to get a response on the MTR filed.
3. Is there any way to get the MTR processing expedited.
4. If the MTR is rejected, then can I apply again for the H1B in the coming year.
5. Will there be any ill-effect on my H1 application if the MTR is rejected.
6. If MTR is rejected then is there any way to apply H1 again under cap exempt.
