HI,
I have my fiancee working in sydney on work permit(H1 equivalent). I am on H1 in US. He went for H1 stamping in sydney but got rejected(in december 2005). Can I go to sydney, marry him there and then can he apply for H4 at sydney consulate again? He got into an accident and cant travel to india for another 6 months. Can that be a valid reason to apply for H4 from outside the home country? he has been living in sydney for the past 3 years.
Will the rejected H1 have an affect in applying for his H4?
