Travel on H4 while Spouses H1-B is getting transferd
Hi,
I am currently in US with H-1B visa and my wife is visiting India, scheduled to return on April-8-2017. She is on H-4 visa. My organization was acquired by a large organization and they are planning to transfer my H-1B visa to the new organization. Initially we wanted to wait to initiate the transfer until my wife is back in US, but due to USCIS's new suspension on premium processing from April-2017, my employer wants to file the transfer by March-30-2017.
If my H1-B transfer is initiated on March-30-2017, can my wife return to the US on April-8-2017, while the transfer will still be under process? Her H4 (and my current H1-B) is valid until October-5-2017.
