My spouse wishes to move to H4 based on my H1. However, she had already submitted an extension for her H1 Visa which was set to expire by 31 DEC 2017. If process her H4 from my company while her extension is in progress and If she initiates resignation say now before she receives the approval, can her employer still withdraw her H1 from USCIS and recover the fee. If not, would the employee be made to reimburse the cost?
