Hi,
I have got an NOID when my current employer applied for an extension in October 2017. The reason being the initial petition filed under master' cap when my university is a for profit organization.
Initial H1B filed April 2012, approved in May 2012.
Transfer filed in 2015 Feb, got approval for 3 years.
Extension filed in Oct 2017, got an NOID.
I am reaching out to different attorneys at this point.
1) NOID is issued on initial petition filed in 2012, upon denial will I be counted as working illegally from 2012?if so will I be barred for 3/10 years from entering US?
2) My current H1B expires in December , can I withdraw this petition and apply new H1B in April 2018 under general quota?
If there is anyone who has been in the situation , please reply your experiences and what are my better options now.
