NOID H1B Extension
Hi,
I received NOID when my current employer filed an extension in Oct 2017 with a reason that my initial H1B petition was filed under master' cap when my university is not eligible for the quota.
Initial H1B filed in April 2012, approved in May 2012
Transfer filed in Feb 2015, approved for 3 years.
Extension filed in Oct 2017, got an NOID.
1) USCIS issued NOID on my petition from 2012, upon denial will I be considered illegally working from 2012? Will I be barred for 3/10 years from entering US?
2) My current H1B expires in December, can I withdraw current petition and apply new H1B in general quota for April 2018?
If there is anyone who has been through this case, please reply with your experiences and any better options I can take.
