- I got by H1B stamped with Employer A, in October 2017
- I was laid off from Employer A, and I'm in 60 day grace period. I think Employer A would have notified USCIS for revoking H1B.
- Employer B is filing H1B Transfer under Regular Processing and I can start working with them based on "Receipt" by mid Dec.
- I'm on final stage of interviews with Employer C.
My questions:
1. If Employer C files for H1B transfer, Can I switch and start working with C based on 'receipt' ?
Can I give them pay-stubs of Employer A for transfer? They would be transferring in Jan and I will have Oct pay-stubs.
2. My major concern is - if Employer B gets RFE after a month or two after I leave, they will withdraw the petition stating I'm no longer working for them. In that case, would my stay (Dec-Jan) become illegal, as my 60-day grace period is over by Dec 25th ?
