Brief description:
My I-129 petition got denied on Tuesday, Dec 5th, 2017.
I am working for the current employer since 2010 and this is the th time applying for H1B extension… Not sure what went wrong this time for it to get denied.*(I am guessing its a level 1 LCA RFE might be a reason - Due to typo in LCA).
I filed my H1b extension on 05/09/2017
My I94 got expired on 09/31/2017
I got an RFE on 09/11/2017
The RFE reply was sent with all the paperwork on 10/04/2017
On 12/05/2017, my status shows that the petition was denied.
My wife's H4 status shows the same that it was denied.
My employer is usually very thorough in filing the paperwork so not sure what went wrong.
I have an approved I-140. (PD 2010)
Few Questions:
1. Does this mean my only option is to apply for MTR? My employer wasn't too optimistic about the MTR. Anybody has any experience about the MTR process, any advice?*
2. My employer started process of filing a new petition (Obviously, I will have to go through the stamping process and deal with that but as per my employer that seems to be a better option.)
3. Can I go to Mexico or Canada for Stamping?
NOTE: We still haven't received the denial notice so not sure what the details are in there.
