H1B extension based on I-140 if currently outside USA and only 1 month left on H1B
Hi All,
I would appreciate help on below situation:
My GC case is with Law Firm and currently waiting to file PERM. However I have already traveled back to India and still have only about 6 weeks remaining for my 6 years max out period.
So once my PERM approved and then I-140 is approved what are my options to get H1B extension? Since only 6 weeks left on H1B, will it go though CAP or non-Cap.
What is the fastest option for me to go back to USA in this situation?
