Little background. I am presently on F1 STEM OPT that ends in January 2020. My employer had filed for H1B but I have not heard back from USCIS yet. The check has not been cashed too which I am treating as negative. My employer had also initiated the GC process and presently the PERM is under review / audit. Now, I will have one more shot at the H1-B visa in 2019 but thereafter none if I do not make it.
So here is my question - assuming in June 2019, I find no H1-B visa and STEM OPT ending in January 2020, what will be options to stay in USA and continue my employment. I am guessing by then, my GC process will be more advanced like i-140 processing etc.
Any guidance is welcome. I will be talking to my company lawyer soon but need to figure out my options. My employer has offices only in North America and I hold an Indian passport.
