Hello Experts,
My Spouse was on H4 with me from 2013 and we filled H1 in 2014 and granted H1 effective from Oct 2014 but she never used it as we had to come back to India. We came back by 23rd Oct 2014.
My company is filling L1 for me now.
Hence my question was
1) whether she can use the expired H1B to get an L1
2) Or we can get L2 for her and then file EAD
3) Will there be any issue in Stamping for L2. Will Attorney ask any question as to why H1 is unused etc, etc.
