    Cap-Exempt H-1B Query

    Hi,
    My H1-B petition(Form I 797) was approved in 2006 and visa was stamped in the same year. However, I never went to USA and the visa was expired. I wish to apply fresh H1-B now. Am I eligible to apply for a fresh petition under H-1B Cap-Exempt?
