Does H4 require the H1 holder to have the visa with the currrent employer

Hi!

I am an H1 Visa holder and am applying for my wife's H4 Visa soon.
I recently came across something and have concerns for which I think someone here will be able to better advise.

I have recently changed jobs but still have the H1 visa from the previous employer. I have already travelled to india with just the new I-797 and the old visa. However, I just came across someone whose wife's visa was rejected because of him holding the old visa and not having got the new visa stamped with the new employer petition.

please advise.
