Please Help - H4 Processing Questions?
Currently I am on F1 student visa and applied for the H1 visa this year. I got the H1 approval but it will come to effect by 1st of October only.
I traveled to India recently and got married. I came back here on 27th of June. My wife is a nurse and she is trying to come to US. As the first step she cleared all the necessary exams (CGFNS & IELTS) and started GC processing (California State) 9 months back. Now she is waiting for the I-140 approval. The company, which is processing her visa, told her that normally the I-140 approval in California takes about 6 months but since the I-140 processing is on hold for some immigration issues, PROBABLY by September only they will get status on that. According to them after getting the I-140 approval it is going to take minimum 4-5 months to attend the consulate interview and get the GC.
I want to get her here ASAP. I am not sure which way to go about. As far as I know I have 4 options
1) Process her F1 dependent visa.
2) Process her H4 right now, since I have got the H1 approval.
3) Wait until October and process her H4 visa.
4) Wait until she gets the I-140 approval and GC. Which we are not sure when to happen (PROBABLY by next year).
I would like to clarify the following.
1) If I apply for F1 dependent (spouse) visa and let us say she got it denied. Will it affect the H4 visa processing any way?
2) How complicated is it to apply for H4 visa before October (before it is getting effective).
3) If I wait until October to process her H4 and meantime the I-140 approval comes (According to her processing agents they will know the status by September). Will it effect the H4 processing since she is trying to get an employment and GC?
4) If she comes here on F1 dependent or H4 will it affect the I-140 approval and GC processing by any way?
5) If I want to apply for GC with her (after getting I-140 approval) what is the process for that? Do I have to go back to India and be there for a while?
6) What is the current status of Nurse’s GC processing?
7) How long the H4 visa processing will take normally?
