Hi all,
I attended H1B interview in Nov-06.
But it got rejected under 221(g)[white],which says
"In accordance with United States law and Department of State guidelines, action on your case has been suspended…………………………….,
The U.S. Consulate in Chennai is no longer handling your case....."
After 8months of long wait, I received the following e-mail from USCIS,
Application Type: I129 , PETITION FOR A NONIMMIGRANT WORKER
Current Status: Notice reaffirming approval mailed to you and case sent to the Department of State.
On July 16, 2007, we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly.
After 15 days of horrible wait, my employer replied that they had received a notice (I-797c) ,with the following content,
"This is to advice you that we have reaffirmed our previous decision on the above application or petition which the Department of State had previously returned for review.
We have forwarded the case back to the Department of State for action."
I sent a mail to Chennai Consulate regarding my issue.
I received the below reply.
“You may come in to apply if you have the reaffirmed petition (Approval Notice)
You may use your blue sheet to come in on any Tuesday/Wednesday or Thursday between 9 AM and 12 noon.”
But i was informed that I-797C which I got is not the original approval.it is just a receipt notice. from USCIS stating that your petition has been filed,where as I-797A is original approval.
In one of the posts they mentioned that
“I-797C is not the same as I-797A. The original is I-797A. I-797C is a copy that is sent to the employer. The I-797A is sent to the attorney, if you have one. The I-797A is what is required by the consulate for visa stamping.”
I think I can not schedule appointment with I-797C(which my employer got)
I need I-797A whith which I can attend the interview.
According to the above post I-797C is a copy that is sent to the employer and I-797A is sent to the attorney.
does it mean that I-797A was sent to my petioner's attorney or what.
From where I can get I-797A from USCIS or Dept of State or from my petitioner attorney.
How many days it will take.
can i contact Department of state for I797A.
Pls tell me whom should i contact for I-797A.
