    I traveled to US on H4 visa
    This year I got my H1B approved
    I was unable to find job for the past 10 months but I made arrangements with my employer to promptly generate monthly payroll for a gross that compensates the annual gross on my H1b petition

    My employer stopped generating the payroll for the past couple of months(which means that I am in illegal status as there is no payslip to substantiate that I was working)

    Scenario 1:

    As I was unable to find out a job if I plan to change my status back to H4

    1) Do I need to leave US and get my H4 visa re-stamped?

    2) Since I do not have payslips for the past 2 months, will the consular question me regarding the payslips or about my H1b status info when I appear for my H4 visa stamping

    3) What are docs required for H4 visa stamping

    4) In future if my spouse applies for Green Card will my H1b status affect the process

    Scenario 2:

    On the other hand if I continue to remain here on H1b hoping to find a job at some point of time and later if my spouse applies for Green Card and he refers me as a dependent(Based on my H4 visa which is valid for another year) without disclosing any of my H1b status info

    Do you foresee any problem that we would face in this circumstance
