  • H4 Visa for my daughter not processed by BCIS

    Hi All,

My company applied for my H1B extension through premium processing in April'03 and BCIS approved my H1 and my wife's H4 in about 15 days. My daughter's H4 approval notice was not there. Our attorneys kept saying that it was a mistake on BCIS's part and they are trying to correct the same. Now, I see that in the original I-539 receipt from BCIS my daughter has not been entered as a co-applicant alongwith my wife. Our old visas expired on 1 August 2003. Our attorney has faxed an inquiry to BCIS with necessary documents. Would my daughter be treated as Out of status since the H4 has not been applied yet after the expiry of the old visa. What if there was a mistake while applying for H4 and her name was not included by our attorney? Would this affect our permanent residency process? Any suggestions/advise welcome

    Thanks
    Ram
