Hi,
I came to this country on an F1 visa and i did my schooling for about an year. Later i was offered a job and the employer filed an H1-B for me.
The moment they filed, i started working for them, and they have been giving personal checks for me,hoping that they might get the H1-B approval anytime.
A full year passed and NOTHING happened. The company actually got an RFE and they didn't even bother to reply.
Now, i would like to know what options i have? My F1- status has already expired.
1. Am i out of status? If so, does the 3 year and 10 year bar apply for me?
2. Can i approach another company for a new H1-B? If not, Can i get into F1 status again and then apply for H1-B?
Please suggest me as to what i should be doing!! I am very desperate and i have been cheated by the employer.
