GC questions?
hi, I have been working in US for last 5 years with the same employer. My current stammped visa is going to expire on 15th June 09. I will be completing my 6 years of H1B period on 15th July 09. I am planning to move to a different employer who can file my GC. I have following questions.
1. Can the new employer start my GC process from day 1?
2. If the LC happens in next 3 months, am I eligible for the 7th year extension?
3. if the answer to question # 2 is NO, is it bcoz the LC has to be in pended status for more than 365 days?
4. If yes (for Question # 3), Can I be out of US for a 6 month period after my LC clearence and get a extension for those 6 months after that? (totaling the 365 days of pended LC to get the 7th year extension?)
any help is appreciated..i am in a tight timeline ..so please reply ASAP..
