  • H1 Transfer - Out of US

    Hi All,

    I was on H1B in US for a period of 4(Aug - Nov) months, later I came back to India and am currently working for another co in India. In the meantime, I got a offer in US and they have applied for H1 transfer, and my I129 was approved recently.

    So now my question is as I am currently out of the US, can I straight away go to US on my existing visa or should I get new visa stamped.

    Please suggest.

    If you are in US then only you have to maintain "status".
    You are NOT OOS since you are in India.

    You can travel with un-expired visa and new approval papers..

      The word "status" wrt visa has a meaning only when you are on US soil and have an I-94 with you.
