Do I need to wait for H4 COS approval?

Hello all,

My OPT expired on Dec 31 2008. I applied for COS to H4 in Dec. The application for COS is still pending. Meanwhile I got a postdoc offer (H1b exempt from quota).

Can I apply for COS to H1b while my COS to H4 is still pending? Or do I need to wait for H4 approval?

Also, what would my current visa status be?
