Court Proceeding : Issues for H1B Stamping

Hi,
I had a Court Proceeding in 2001 for a misdemenour charge. The case was dismissed later.

I answered "No" to Question # 38 in DS 156 ( Have you ever been arrested/convicted....... ). DO the consulate in India do a background check before Visa stamping. ? What should I do ? Please guide.
