work permit: working on L2 EAD valid till September'2020
my I-94 expires on : October'2020
my husband's
My employer applied my H1B this year and it has been picked.
My husband got H1B approved last year but did not get stamped so he is still on L1.
Since our Visas are expiring this October end we have to travel to India for stamping. After stamping i will be leaving USA on L2 visa and entering USA on H4 visa.
My husband has I-140 approved so I can apply for H4-EAD when I re-enter then but that too takes 4-7 months to process these days.
My H1B is in regular processing and still in pending status and we are expecting RFE as my employer(consultancy) did not submit client letter.
Is it fine if we travel or there is a chance of staying back and wait for h1 result?
