I got H1B approved as Consular processing from India in 2018. But I also had already entered US based on my L1 petition which was filed in parallel. Now since I wish to move to another employer, can they file a Change of Status, or new H1B petition (Cap exempt, I assume) without me getting out of USA and coming back on H1B Status? If yes, can you please briefly explain the process?
I understand that getting out of country and coming back on H1B status from the current employer, and then file for an H1B transfer looks easier on paper, but I would really avoid getting a new visa stamping done with the current employer. Thanks for your help!
