Hi,
My H1B is expiring on MAR-11-2012 with full six year complete. As far i understand correctly, My company has to file my Labor Clearance before Mar-11-2011. Today i got a call from my HR. He said that lawyer thinks that he would not be able to file LC before MAR-11-2011. But it could be delayed by a month or so.
I am really concerned now, because this means, i will be out of status for one month and would have to go back to india on MAR-11-2012 for a month.
Is my above understanding correct?
Why lawyer is saying that he would not be able to file LC before March-2011. Is my HR speaking truth. If i go out of status next year, would i be able to enter USA after a month, incase if my H1B extension is applied.
I have business visa also. If my H1B expires, can i continue working on Business visa?
Can someone be kind enough to help me out with my questions.
