  • H1 B never used and expired, Can I use it

    I am presently on a H1 in the US and my 6 year stay is expiring in 2 months. Since my present employer did not file any green card, I have to be out of the country for one year. I am presently looking at the H1B quota for next year. I had earlier got two H1B approvals (5 to 7 years back), which I never used. For the first H1B, I went for the stamping but never travelled to the US using that visa. For the second H1B, I just recieved the I-797 and never went for stamping.

    My questions are as follows

    a) Instead of applying for the 2011-2012 H1B quota, can I not just use either of the old H1B's.

    b) If (a) is possible, is there any process involved (like getting approvals from the company who filed his old H1B) or my future employer will just take the required documentation and do the required.
