I am going to India for my H1 b Stamping in May. I am a fulltime employee for an engineering firm.
My OPT started on jan 2008 and worked for a company A for an year. and they extended my OPT so i was on OPT Extension. I got laid off in feb 2009. So i joined a consultancy B to support my status. I got a full time job in april 2010 in engineering firm and currently working for them and i got my h1 b through the company.
My question is..i do have w2 for 2009 but from company A for the 2 months i worked and doesnt have a W2 from the consultancy although i was on there E verify system.
I can file my w2 for 2009 but in the visa appication form its asking for my previous employer ..shall i give the name of the consultancy? Is there any chance that my H1 can be rejected because of that. Can i say that i worked for the consultant as volunteer?
I would really appreciate if someone can help me regarding this issue and how tohandle it.
