  • L1 to B2 and then H1B

Currently am on L1B and expiry date is july 21st, one of other company is going to file my H1B, to coverup the Gap with a valid status between July 21st till oct 1st, my lawyer saying to file a B2 now itself, so that they can mention in the H1B petition as B2 pending, what are the chances of success in this case? is this going to be a problem when they see in H1B petition as "B2 pending" and chances of H1B rejection due to this? what is the probability of getting B2 approved? is it safe to file B2 right now or file before a week of my L1B expires? if my H1B gets approved what are the chances of rejection if i go for stamping(i wont be having B2 stamped in my passport)? is there any better way to handle this case?
