  • non-stamped H1B- considered a visa for tax purposes?

    Hello,

I was a graduate student on J1 for two years. In April I was approved H1B. In July I started working for a US employer, first on my J1 Academic Training, then on 10/1 the H1B became valid. I still haven't left the country so still didn't get the visa stamped in my passport.

Now I need to file my 2015 tax return and I'm a bit confused. Do I put as if I was on J1 for the entire 2015 or do I need to indicate the H1B? I'm just not sure if the definition of my H1B is VISA, because the visa questions are: when was the visa issued, when does it expire. I still don't have an H1B visa in my passport, so it was never issued....

    Thanks for the help!
