L2 visa EAD expired, waiting on L1,L2 VISA extension while also applied for H1B

Hi,

I am L2 Visa and i have it till June 23rd 2013, my EAD has already expired. I have applied for H1B and waiting on the approval.
While I also have a B1/B2 tourist VISA too.
While my Husband's company A had applied for L1,L2 extension which is on RFE currently and his VISA is till Sep 1st 2013 .

My question is I wanted to go out of country, now while I do so if my husband's L1 gets rejected.
Can I come back on B1/B2 and get into H1 status from Oct 1st 2013 ?

Please let me know if it is possible.
