Hi,
My company applied for a L1b in the US, they received an RFE which asked the company to prove uniqueness of my skills and speciality occupation, the companies attorney replied back giving all supporting documents; and it got denied saying that it doesnt prove Speicality occupation in terms that any one can replace my job in the US and its not unique in nature, I am an MCA and have worked with the india office of the same company for 3.5 years as a People Soft resource, my company now wants to file L1b again; but my question is if they refer to the previous application that got denied; it will again be denied or will it have some chance of getting through, Also wanted to know i being a project manager in india would qualify more in the L1A slot or to in the L1b Cat****y; in the denial letter they have mentioned tha my role is more of supervisory and only 30% of my job is technical, so as per the companys attoreny L1b is more convincing rather L1A, and the Vice president of the company differs on this ground, let me know what would work best saying if the INS is acknolwledging it as a supervisorly role then L1A would fit more in my case.
