Hi,
My company filed an I94 extn for me and received an RFE. Below are the queries from USCIS.
1. Provide a detailed description of the actions and duties the beneficiary will perform on a daily basis. A simple statement will not suffice.
2. Provide a list of proposed duties which require specialized knowledge.
3. Explain why each duty requires a worker with specialized knowledge.
4. Identify which process, prodcedure, tool, and/or method is proprietary to the petitions, a client, or a third party.
5. Identify how long it takes to train an employee to use the specific tools, procedures, and/ or methods utilized. Specify how many workers possess this knowledge and are similarly employed by your organization.
6. Explain exactly how the beneficiary’s training differs from the core training provided to your other employees.
Duration of the courses,certificates of completion
7.Provide a copy of contract for services between the petioner and the employer where the beneficiary will be primarly stationed
8.Provide an addendum to the contract singed by a representative of your companay and the offsite employer
9.To what degree wil the benefiery be controlled and supervised by offsite employer compared to your company
I am preparing the documents currently and I need your advice in presenting it strongly to USCIS.
My petition to USCIS mentioned that i have specialized knowledge in 5 tools from my company. Should my RFE response documents be emphasizing more on these tools? Or should i focus on something else? What about the questions on 8 and 9... Please advice me and appreciate your help guys
