I applied for COS from L1B to F1 in Dec’13 with I-20 stating Spring’14. I quit my job in Feb’14. My current status is “Pending” as I am not sure if my L1 has been revoked yet; my L1 visa shows it's valid till Jul'14, I-94 already expired.
I started school in Spring ’14; and wasn’t aware of the deferment process (didn’t receive any notice from school either!).
Received 3 RFEs from USCIS this week,: 1st one I find out that my school had “cancelled” my F1 in Mar’14 without any notice. I contacted my school DSO requesting a deferred I-20 for Fall’14 and to restore the F1status back to “Initial”. 2nd RFE was for I-901 receipt; which I forgot to pay. I only paid the USCIS $290 amount for COS; wasn't aware of the SEVIS fees. Now I think I can pay only after status is changed by the school, right? Does this affect my approval?
3rd RFE is for providing proof of maintaining L1B;(recent stubs, W2 etc.). I'd eed to explain this to USCIS since I was employed at the time of filing, and can give paystubs of Jan/Feb'14.
For the current semester, I’ve enrolled for only 3 credits for Summer. My DSO stated that I shouldn't have taken any since I am on "pending" and don't have a stable visa. I plan to continue with the course, but now I am not sure if this course will be considered for me to graduate? Does it add complications in the process of F1 visa approval?
My husband is on H1B; we have twin boys (1 yr old; born in US). Pls provide ur expert recommendations on my case. It's become messy, do you recommend I have a lawyer.
