I've been doing my homework, reading in forums, asking lawyers, but I am still confused about the right proceding for me to "adjust my status" while being married to a US CITIZEN. Im going to explain my situation, is a little long but please beg with me...
I am a Colombian citizen who came into the US as a B2 status..My wife and I have been together for 1 yr and 1/2, I met her through school, I studied here int he US for 4 years on a F-1 status. When I entered the country in january 15/ 2011, the last thing i was thinking about doing was getting married. My girlfriend flew to Colombia to spend new years with all my family. After the holidays, my wife, at the time girlfriend, my brother ( who just graduated from college in may) and I returned to the US. I was inspected by the officer, and my intention was only to go for my brothers graduation which was on MAY 14/2011, my returned ticket was for may 28/2011. Everything went fine, my parents came from Colombia as well for my brothers graduation, he indeed graduated with a nice ceremony at his college ( we have prove of the ceremony and dates, Commencement book, diploma which says the date of the graduation) and after that we were supposed to do tourism until we had to go back to Colombia. I had an emergency surgery ( Apenndix removed, I have the paperwork) and the doctor told me I couldnt fly for long period of time because it was dangerous after a surgery like th eone i had. So i changed my flight date to July 14/2011, which is the last day of my I-94. During that week that i was recovering from my surgery, my girlfriend asked me to marry her, of course we had to wait a couple of weeks because I could bearly walk. and we finally got married. My questions are the following:
1) I didnt intend staying here and change my status, it was just something that happened along the way.
2) If I file my documents before july 14 2011 which is the date my I-90 expires would I be able to start my process of adjusting my status? i have the I-130, I 485, I-765, I-131, G325 A for my wife and I, the I-864 With my sponsor, which is my wife, and also my cousin who is also a US CITIZEN.
3) what evidence I would need to prove this is a legitimate marriage and that i didnt intend to stay in the US?? we have a joint account, we are independent business owners and we both appear on the contract agreement, we have a lease for 6 months which started in july 2011 and both of our names are in it, our phones are on her name since november 2010, but i appear as a user and the address of the bills is our apartment, my brother also appears as a user. my name appears on the electric bill, national fuel bill, and cable company, she also appear as the user in those accounts, we owned a dog, we got him in November 2010, and his paperwork is in both of our names. She has been to Colombia 3 times, we have the boarding passes and also the passport stamps. pictures since we met, my family when they came to the US met her family and there are also pictures. In our wedding her sister, dad, mother, grandma and family members were there, we have pictures of it.
I dont wanna leave my wife now, this was something we didnt planned. I wanna know if showing the proof that my brother graduation in fact was on the dates i mentioned before they would consider my intent as not trying to stay in the country after entering as a B2.
