Hello Attorneys,
I need legal guidance on OPT eligibility while my F-1 reinstatement is pending.
I completed my Master’s degree in Dec 2024. My SEVIS and I-20 are active under reinstatement pending. I filed Form I-539 on Aug 22, 2024. USCIS issued an RFE on Jan 23, 2025, received my response on Feb 25, 2025, and completed biometrics on May 23, 2025. The case is still pending. I am in the U.S., not working, and within the 60-day OPT filing window, which is about to expire.
My DSO says they cannot issue an OPT I-20 until reinstatement is approved. I already have a job offer. My employer’s PERM is approved and I-140 has been filed.
Questions:
Can a DSO issue an OPT I-20 while reinstatement is pending so I can file I-765 before the deadline?
If OPT is filed during pending reinstatement and reinstatement is approved later, can OPT still be approved even if the window passes?
If OPT is lost, but reinstatement and I-140 are approved, can I file I-485 when my priority date is current?
