30/60 day rule
Hi all,

This post is a continuation of a previous post regarding my Interview that did not go well.

Thanks for your great feedback, I can rule out Legal status at the moment of filing from the list of my concerns.

However, a lawyer told me that the IO was probably trying to trap me under "misrepresentation of nonimmigration intent". I was already in University for my 3rd masters degree when I met my wife. Therefore it does not make sense to allege that I misrepresented my non-immigrant intent when i reentered the US in 2012 with a new F1 visa (I got my undergraduate degree in the US back in 2008, left to work in my home country and returned in 2012 for my Masters).

My question though is: Does the 30/60 day rule apply when you first enter the US with your non-immigrant visa (in my case F1) or does it apply for any subsequent entry and exit to the country for vacations and such after being in the middle of University already. I last reentered the US in December of 2016 after being home for the holidays with my wife (then Gf).

Thank you all. Please refer to my previous post if it helps.
