Family based Petition
Hi All

Need guidence for a very important issue regarding our petition filed under family based petition by my sister in law in US.

Now the thing is our petition was files in 2005 and at that time my Husband was there in US ,Staying out of status .The thing is he had gone on tourist visa and had to stay back because of his mother serious illness who was a US citizen but died in the year of 2009 and than my husband came back in 2010 since after mother's dead he didnt had any reason to stay back in US.

Now the status on the USCIS website shows us the status of our file as the wait period of 13 months for the call in the US embassy in the home country and also we have got a letter of approval before that from the USCIS .And when the petition was filed in that it was shown as my husband in US but since a year n a half he left US and now in India.

So my question here is will there be a call from US embassy for the Green card interview in our country after this history of my husband or they will bann him for 10 years and than we shall get our green card and by luck if we get an interview call for green card than are there chances for is to get a green card.

Please if any one knows what can happen in this situation.
