Can US citizen apply AOS for his father who is undocumented since 2013(came by B1 visa) or he needs to go by consular process?
My friend got his Permanent Resident Card through marriage based. His father came to USA on 2013 by Business visa, but he did not go back to his country. He is undocumented now. He did not apply for asylum or any other case. So my question is, after my friend achieve his citizenship, can he apply for his father for greencard? Does his father need to go back to his country, or he can stay here and my friend can apply AOS for him ? Thank you.
