Adjustment of Status - I-485

hello i have a dilemma with my husbands i-485 petition i hope someone has gone through a similar case as us and can help. ok so my husband his mother petitioned for him when she was a legal permanent resident he was protected under the 245i law, but he isnt able to file for adjustment under his mom because we got married while she was still a legal permanent resident. we were told that even though he doesn't qualify under her and since i am US born citizen he could still adjust status under me here in the US because even though we got married he is still protected under the 245-I Law. so we did all the process but where i have the doubt is that i got a letter that they want his moms I-864 affidavit of support as if she was his petitioner. we had sent a letter stating that he no longer qualified under his mom and that i was his new petitioner and that is why i was sending the I-864 under my name. we sent out all the necessary paperwork except the I -130 from me to him since i was told he didnt need to send it anymore since their was already an I-130 filed for him from his mom and one from me to him wasnt required. if anyone was gone through something similar please let me know the outcome. im scared that well go to the interview and that they are mistaken and think that his mom is still the petitioner and tell him he cant acquire residence because of some confusion.
