Need help - AOS EAD
Hello all,

I am in desperate need for some help and advice form you all if possible. I am currently employed on my H1B visa that is to be expired October 31, 2020. I filed the application for AOS marriage based GC which is currently at pending I-485 stage. My FO is Louisville, KY and I am waiting on to be scheduled for the interview since January 2020. I have an approved EAD until 01/21/2021. I submitted paperwork for renewal of my EAD.

My current employer is not able to file for my H1B renewal since the prevailing wage to meet for my position has significant gap with my salary. Per documentation, I am underpaid which is not completely true. Nothing has changed in my position and everything is same since it was filed the first time.

The question is, starting November 1, can I used my Advance Parole and EAD card for my employment and be in good standing while my application is still pending and in process. And then once I get the renewal, I ask HR to update it with the new expiration, correct?

I need some guidance on how to make sure my employment is not jeopardized and I am following the right guidelines.

Any advice or suggestions are helpful.

Thank you!
