RFE on I-485
Hi everyone,

I recently received RFE on my pending family-based I-485 application and my question is related to it.

I am married to a permanent resident (GC holder) and have a pending I-485 application and my priority date is 07/05/2019. At the time of my application, I was on my F-1 visa and to be precise, in Cap-Gap Extension period as my H-1B was filed by my employer which ultimately got rejected. On 02/06/2020, I received the RFE that I may be subject to Section 212 (e) of the INA and I need to provide relevant documents to establish that I am not subject to it. Now, this particular section applies to those who have entered the US as a J-1 or Exchange Visitor. Technically, I do not belong to this category of visa, however, USCIS has issued RFE related to it and is asking me to submit documents of proof.

I would like to seek advice from someone who has experienced a similar situation and if you can also guide me with what documents that I can submit. Thanks in advance!
