Hello guys. Please help me with your best. I’m on H1B & my wife and two kids are on H4 visa. I’ve SSN. My wife & kids applied for ITIN. My wife already received & two kids are waiting to receive. I already filed 2019 federal tax with my SSN & wife’s ITIN. That’s why we didn’t received Covid relief check. Soon will file state tax.
Our I-485 applications are pending (including me). Recently, we got our EAD & AP. Today my wife & two kids received their SSN based on pending AOS. We don’t want to use our EAD/AP. We would like to be on H1B/H4 status.
Now my questions are, can my wife & kids use their SSN instead of ITIN? If so, Does it violate their visa status? How they can update their federal tax files information to include SSN? Is it still possible to receive Covid relief check for all of us?
Please help me to figure it out. I talked with our lawyer but he has not enough knowledge on this issue.
