I485 AOS Interview
Hi Friends,
I live in Orlando, FL.
In Dec 2015 visa bulletin based on “table B” I am eligible to apply for I-485 application because last year I filled I-130 application and my PD come April 24 2015 for f2a category.

I484/i-131/1-765 bundle send to Chicago lockbox.
Jan 27 - PD
Feb 24 - Fingerprints Completed
April 22 - Received EAD with Advance payroll in mail
June 2 – Received Interview Notice
June 27 – Interview @ Orlando Location

I had my interview last week on 27th June 2016 and it went for 5 minute. Now after my interview same day in afternoon I got a call from that officer who took my interview and she told me she is declining my application as my PD is not current so she is not aware of new rule which came last year for TABLE-B and It’s says eligible application date for I-485 application in visa bulletin, also I told her I have completed my fingerprints and I received EAD with advance payroll. So she did some research from her side too and she called me back in one hour now she told me not to worry about this and she is not declining my application only thing she said, she is not approving my interview as my PD is not current. So once my PD will current then my case status will update.

Now after 4 days on 1st July I received a letter from USCIS regarding my interview and in that letter they mention “Currently visa is not available to adjust your status and your case is transferred to NBC to await the time when a visa again becomes available to you”.

Now my question is will I get another Interview notice when my PD become current or direct GC card and meanwhile do I need to call USCIS and make sure that they are not declining my EAD/Advance Payroll because of the confusion they have regarding the dates in their visa bulletin and Interviewer officer is not aware of this.

Currently I am on H1 visa and what if I start working on EAD and USCIS did something by declining my EAD which makes me in trouble.

Please provide your input.
