Adjustment of status while out of status and married to a LPR
Hey guys I need help.
I came to the US as a student. Once I've had issues with immigration for falling out of status but the judge closed my case because it was not my fault.
I got back in school, graduated and did my OPT. I got married in May 2015, my OPT ended in July 2015. My wife who is a LPR filed I130 for me and it was approved in February 2016 with a priority date of 9/23/15. So now I'm out of status since July 2015.
However, USCIS is now using two charts for visa availability and adjustment of status. This month of October they posted that the chart for filing dates for family sponsored visa applications must be used instead of the final action dates for family sponsored.
On the dates for filing family sponsored visa applications my priority date is current.
My questions are:
1- Should I submit my adjustment of status?
2- since I have been out of status (overstayed) will I still be able to adjust status?
