I-765 delay after RFIE
Hi all,
I am applying concurrently for a marriage based I-485, I-130, I-765 and I-131.
PD 06/01/2016
Biometrics done second week of July.
Request for Initial Evidence on I-485 08/04/2016
Response on RFE Received by USCIS 8/26/2016
My case status for the I-765, I-130 and I-131 still showing up as case received, and case has already been pending for 129 days. On 09/22/2016 I raised a service request, as the case was pending for 113 days, more than the 90 days regulatory limit and just above 90 days if I subtracted from it the 22 days between the date of the RFE request and the date the USCIS received my response.
The response I got from them the next morning was that the case is still within the regulatory time frame, as there was a request for initial evidence on my concurrently filed I-485 form, and that they would process my case within 90 days from the date of response (26 Aug).
I am wondering if anyone is in a similar situation, and if I will really have to wait that long. I am trying to be patient, but I was originally supposed to have started with my prospective employer at the beginning of September, and if I have to wait the full 90 days from the response to RFE date, it will be almost December already.
My case is at the National Benefits Center, and start with MSC.
Any comments will be greatly appreciated.
